The ENCJ Executive Board issued a statement addressing two pressing concerns related to the situation of the judiciary in Bosnia and Herzegovina.

Firstly, the recent legislation in Republika Srpska (RS) that challenges the authority of the High Judicial and Prosecutorial Council (HJPC) and threatens judges, prosecutors and members of the Council from RS with criminal sanctions.

Secondly, the draft legislation on the HJPC, which falls short of addressing the issues outlined in the previous opinion of the ENCJ and other institutions.  

The ENCJ Executive Board underscores the essential role of judicial independence in upholding the Rule of Law and commits to ongoing monitoring of the situation.
