ENCJ General Assembly 2015 in The Hague PDF Print E-mail

The 2015 General Assembly of the ENCJ meets in The Hague on 3-5 June. General theme of the Assembly in the Peace Palace will be ‘promoting effective justice systems.’ 

The ENCJ gathering will kick off at the headquarters of the Netherlands Council for the Judiciary in The Hague on Wednesday 3 June, with a closed door session on administrative matters followed by the opening reception for all participants. The latter will be co-hosted by the Mayor of The Hague and former Minister of Foreign Affairs Jozias van Aartsen.

ENCJ is honoured that both European Commissioner for Justice, Consumers and Gender Equality Vĕra Jourová and Advocate-General of the Court of Justice of the European Union Eleanor Sharpston will deliver the opening remarks at the General Assembly in the Peace Palace. 

A series of interviews were commissioned by the Dutch hosts of the General Assembly with a.o Vĕra Jourová, Geoffrey Vos and Frits Bakker. The interviews and other information regarding the General Assembly can be found on the website of the Netherlands Council for the Judiciary

 
Council of Europe report reveals weaknesses in Judicial Systems in Europe PDF Print E-mail

A report from Secretary General Thorbjørn Jagland indicates that there are widespread weaknesses within Europe's judiciaries. According to the report this is now apparent in over a third of the Council of Europe member states. In many cases only poor safeguards against corruption are in place and public trust in the system is weak. Among the most concerning shortcomings are: lack of independence and autonomy of judicial councils; varying degrees of executive pressure on the judiciary; opaque recruitment, nomination and promotion criteria for judges and corruption.

The 8th edition of the Council of Europe Prize “Crystal Scales of Justice” for innovative practices contributing to the quality of justice is being organized. The aim of the prize is to identify and promote innovative practices regarding the conduct of proceedings, court organisation and the functioning of court systems in general. To be eligible for consideration, the practices nominated must have been implemented recently and they should be easily usable by other States or jurisdictions. Their efficiency must be measurable. On 9 March 2015 the European Commission published the 2015 EU Justice Scoreboard. The Scoreboard contains indicators in the following fields: Efficieny of Justice Systems; Quality of Justice Systems and on the Independence of the Judiciary. It contains an updated section on the legal safeguards presented last year and provides a comparative overview on structural independence which were realised through close cooperation with the ENCJ. In the EU Justice Scoreboard reference is being made to the Guide to the ENCJ.

Italian CSM starts mandate PDF Print E-mail

In September 2014 the new members of the Consiglio Superiode della Magistratura started their four-year mandate. Under Italy'sConstitution the CSM is the self-government body of the judiciary; it is competent for recruitment, allocation, transfer, promotion, and disciplinarymeasures in respect of magistrates. 

csm_italy_2014_2018The CSM has 24 Members including 3 ex officio members; the President of the Republic, chairman of the CSM, the President and Prosecutor General of the Court of Cassation, 16 career members elected by their peers (2 magistrates from the Court of Cassation deciding on legitimacy issues; 14 magistrates discharging prosecution/judicial functions on the merits) and 8 lay members (elected by the two Houses of Parliament in joint sitting by secret ballot from  a shortlist of university professors in law and lawyers with at least fifteen years of professional seniority). 

The members hold office for four years and may not be re-elected for a consecutive term. The Council elects, from among the lay members, a deputy-Chair, who will chair the Council plenary sessions whenever the President of the Republic is absent, or else upon the President's delegation, as well as chairing the Presidency Board. Mr. Giovanni Legnini was the elected as Vice-President on its first meeting held on 25 September 2014.
