The ENCJ studied the subject of liability of judges in 2007-2008. The ENCJ report on liability was presented to the General Assembly in Budapest in May 2008.
The working group identified responsibility mechanisms that respect the independence of the judiciary whilst at the same time increasing public trust.
When analysing responsibility and professional ethics, prudence must be used in order to protect judges' ability to act independently from all undue pressure and manipulation so as to preserve the impartiality and effectiveness that the public is right to expect of the judicial system.
The report deals with the criminal, civil and disciplinary liability and responsibility of judges. |
