ENCJ promotes the interaction between the judiciaries of Europe in order to improve collaboration and to stimulate the exchange of best practices which will reinforce mutual confidence. ENCJ believes that the identification of minimum judicial standards and the relevant indicators in these particular fields provides a tool for self-evaluation for the judicial systems and will further the approximation of the judicial systems in Europe. This will support the development of independent Councils for the Judiciary and contribute to the attainment of a European Judicial Culture.



Standards for the evaluation and irremovability of judges
In 2012/2013 has been further developing the topic of Minimum Standards. The report on Minimum standards regarding evaluation of professional performance and irremovability of members of the judiciary has identified relevant minimum standards in the field of assessment of professional performance and irremovability of judges and prosecutors. In order to make it possible to self-evaluate those standards at a later stage a set of indicators will be drawn up. The ultimate goal is to thus strengthen mutual confidence among judges and prosecutors from different jurisdictions within the EU and contribute to the evolvement of a European common judicial culture.
 
Standards for the selection, appointment and promotion of judges

ENCJ report on Minimum Standards 2011-2012

In 201/2012 the ENCJ continued its work in the area of development of minimum standards for the justice sector.  The report sets minimum standards for the selection, appointment and promotion of judges. The report was officiallly adopted in Dublin at the General Assembly with the adoption of the Dublin declaration.

In 2012-2013 ENCJ will further its work in the area and focus on the evaluation and irremovability of judges.

 
Strengthening Mutual Confidence: Standards and Evaluation

ENCJ Project on Standards and Evaluation 2010-2011

In 2010-2011 the ENCJ worked on the theme of Standards and Evaluation. The project falls within the scope of the Strategic Objective that aims to promote best practices in the Justice Sector for Quality Management. The report puts forward proposals for minimum standards in the areas of recruitment, selection and appointment of judges; judicial training and judicial ethics. The questionniare report is the collection of answers received from the ENCJ Members to the questionniare that was drafted by the project team.

ENCJ working group on strengthening Mutual Confidence 2009-2010

"Mutual confidence: towards a European judicial culture"

In 2009-2010 the working group on Mutual Confidence continued the work done in the previous year on training and evaluation. The Mutual Confidence report and recommendations 2009-2010 focuses in detail on the topic of evaluation and the responsibility of the European Judiciary to develop a set of representative minimum standards for the Justice Sector. The report also calls for a European attitude of Judges.

ENCJ Working Group on strengthening Mutual Confidence 2008-2009

“Strengthening Mutual Confidence: training and evaluation”

In 2008-2009 the group held two meetings. In the ENCJ report on Mutual Confidence 2008-2009 they came to the following conclusions:

  •  to conduct further work in relation to issues on the evaluation of the rule of law in the European Union;
  •  to be particularly present and active in the European debate on the issues of judicial training;
  •  to promote the Dutch model of the “Court Coordinator for European Law” which already proved its efficiency in the Netherlands;
  • that the ENCJ continues its work on the “Mutual Confidence”, but giving the priority to training and evaluation.
